how do i find about indian rights?
i have three childeren who are more than three quarters apache, their mother has been incarcerated permanent style, so i can't get any help from her and i need to know how to get to their heritage, liniage or what ever, set so we could possibly get them set up with the rights they are intitled. i'm 116 cherokee, but pretty much white. i now have been estranged from them for 4 years untill now, been fighting for birth certs, legal records ( which were stolen from the house she was arestted at) so i don't know how to start as far as the indain rights go. she would rather them go without than give the info help?
A person must be a citizen/member of a US Federally Recognized Tribe to be eligible for programs and services reserved for American Indians. The first 'must-have' to becoming enrolled is to be a direct, lineal descendant of an enrolled member/citizen. The second requirement is sometimes a minimum blood quantum. The actual number though is up to the tribe itself. If your children are direct, lineal descendants of an enrolled tribal member/citizen you need to contact the tribe of enrollment for their mother. Verify she is enrolled and ask about enrollment requirements for your children. Assuming they're eligible for enrollment you'll have to complete an enrollment application and supply necessary paperwork such as birth certificates which you can order from the county where they were born. Once the kids' application is complete, the tribe will decide whether or not to enroll the kids. Enrolled tribal members/citizens of US Federally Recognized Tribes qualify for services through Indian Health Services. The health care benefits are non-transferable to non-IHS facilities. Any other 'benefits' would come from the tribe of enrollment directly. Standard benefits are a right to vote and eligibility for citizenship-based tribal programs.
That being said, how can they be more than 3/4 Apache? Even if their mother was 4/4, the most they could be is 1/2, unless you're Apache too. But you didn't say you're Apache. From you, if you are 1/16 Cherokee, they'd be 1/32 Cherokee, giving them a total blood quantum, best case scenario, of 17/32, 7/32 (which is quite a lot) short of being 3/4.
